OFFICIALS ACCUSED FOR WRONGFUL EXECUTION
Chiang Kuo-ching, a soldier who was wrongfully executed by the military for raping and killing a five-year-old girl 15 years ago, was eventually found innocent after the real murderer came forth in admitting to the crime.
The legislators are now asking the chief of air force command and the director of the air force's Political Warfare Bureau at that time to apologize for the cruelty in forcing Chiang's confession, in addition to the flaws of the investigation process.
President Ma Ying-jeou has also ordered the Ministry of National Defense to review the entire case, with the prosecutors currently conducting an investigation on who should be held responsible for the unlawful judgment.
The Chiang family accused the air force command of the long and illegal interrogation 15 years ago that threatened Chiang Kuo-ching to confess.
Former chief of air force command Chen Chao-min violated the administrative procedure and ordered the counterintelligence unit to take over the case.
Chen and former director of the air force's Political Warfare Bureau Lee Tien-yu were even awarded for closing the case quickly.
Now it seems very ironic.
Both lawmakers from the ruling and the opposition party are asking the two to apologize and to be held legal responsibilities over the wrongful conviction.
Prosecutors are to summon Chen and Lee for questioning.
Legislators believe the government should ask them to return the pension and apologize to the Chiang family.
However, according to the current legal system, one can only file for wrongful imprisonment compensation with the court's proof that it was a wrongful conviction and the person in question was claimed not guilty.
In terms of civil justice, the national compensation has passed the deadline of prosecution of ten years and the Chiang family needs to provide evidence that Chiang was indeed threatened physically when he made the confession.
For the family, it's still a long winding journey to achieve justice.
